FXSSI LTD ("FXSSI", "company", "we", "us", "our", "website") takes the security of the personal data of our clients, potential clients, and others who use our services seriously. What personal information does FXSSI collect about you?

Information provided by you. We may collect some information from you when you register on our website, place an order for our services, respond to a survey or marketing communication, surf the website, or use certain site features.

  • your login data, interests, preferences, feedback, reviews, and survey responses;

This information will not be publicly displayed.

You are not obliged to provide us with your personal information. However, without that information, FXSSI may be unable to open an account for you, where the information is requested in an application form, or to provide you with some of its services, information, or assistance you have sought.

Information collected automatically. We may also collect some information from you automatically when you use our website or services, regardless of whether you have an account.

This information may include but is not limited to:

  • device information (for example, device type, IP address, screens resolution, browser type, browser language, and operating system);
  • usage data (for example, information about how you use our website, products, and services);
  • pages and links you interact with while using our website;
  • transaction data (for example, order details, payments from you, and other transaction details
  • you have made using our services);
  • data collected through email messages (for example, whether the email was opened or some links were clicked).

The automated collection mostly refers to technical data. Please mind that technical information is not personally identifiable information from your profile. But in some cases, it may be combined with your personal information to the extent permitted by law. In this case, we will treat and protect the combined data as personal information.

Collecting this information enables us to better understand the visitors who come to our website, where they come from, and what content on our website is of interest to them. We use this information for our internal analytics purposes and to improve the quality and relevance of our website to our visitors. We may also use this information for security purposes to prevent abuse of our service (e.g., to detect and prevent fraud, spam, fight malware, and identity theft).

Log files. We use this data to administer our website, gather traffic information for analytical and planning purposes, and ensure that a user adheres to our Terms of Use.

Information collected through our desktop products. Our free desktop products do not collect any of your personal or technical data.

Our Pro indicators may use some tracking technologies and collect some technical data about your device, such as:

  • MAC address,
  • IP address,
  • CPU info,
  • RAM Disk,
  • and some other device characteristics.

We collect this data to connect your FXSSI account with your terminal and provide you with our products and services according to our obligations and your subscription plan. We do not get access to your trading account.

Third-party sources. From time to time, we may receive personal information about you from third-party sources, but only where we have checked that these third parties either have your consent or are otherwise legally permitted or required to disclose your personal information to us.

For example, if you choose to Sign Up/Sign In to our website using a third-party account (e.g., Twitter, Google), you give us permission to obtain your account information from that third-party platform.

We may also combine your data from third-party platforms with information that we have collected and use it to enhance the services we offer you, such as providing curated content that is relevant to our services or topics you are interested in.

How does FXSSI use your personal information?

The processing of your personal information is necessary for:

  • providing you with the services or products you request, or carrying out our obligations to you;
  • meeting our legal or regulatory responsibilities, complying with applicable law;
  • pursuing legitimate interests of FXSSI or any third party without affecting your interests or fundamental rights and freedoms.

When we refer to our legitimate interests, we, however, consider your rights under data protection laws. Therefore our legitimate interests do not override your interests. We do not process your personal data in areas where our interests override the impact they may have on you unless we have your explicit consent or such processing is required or permitted by law. You have the right to object to the processing of your personal data at any time, on grounds relating to your particular situation.

Providing products and services. We use the collected information to provide you with services that you have requested, including managing your account and administering the products and services provided to you. This data also helps us personalize our service to you, including saving your settings and preferences or delivering the type of content and product offerings that may be most interesting to you.

Customer service. This information also allows us to better respond to your customer service requests and provide customer support. For example, when you start a ticket, we may use your contact details, information about your device, server logs, a description of the problem provided by you, along with any other supporting materials (videos, screenshots, etc.) to help resolve your issue(s) as quickly as possible.

Order processing. We may use provided information to quickly process your transactions in case of any purchases on our website.

Security purposes. Where permitted by law, we may use information about you to protect our company, our customers, and our website and exercise or defend any legal claim.

Communication. We may use the information to contact you to respond to your inquiries or questions and discuss your account. From time to time, we may send you necessary service-related notifications (service interruptions, functionality upgrades, new major feature releases, etc.). We may also contact you in connection with security, privacy, and administrative issues related to your use of our services.

We may use your data to send you commercial (marketing) notifications containing additional information about services, current promotions, and special offers related to products and services provided by FXSSI. You can opt-out of this communication at any time.

Surveys and feedback. We may occasionally send you surveys or contact you regarding your feedback about our services as it is in our legitimate interest to ensure that you are satisfied with our products and services. If you consent to participate in such communication, we may collect and process information provided by you in aggregated and depersonalized form.

Job offerings. In case we post a job offering on our website, and you reply to this offering, we may collect and process the information provided by you to analyze your skills, qualifications, and suitability for employment.

Analysis and research. The company may also use your data to conduct internal statistical and business analysis or other research based on aggregated anonymized data that cannot individually identify you. The collection, processing, and storing of this information is required by our legitimate interest and legal obligations.

Service improvement. We may use this information to improve the quality of our website, products, and services, their ease of use, develop and test new functionality, as well as to detect, prevent and address technical issues.

Solving disputes. It is in our legitimate interest to quickly and efficiently investigate and solve any disputes between our company and our users. Therefore, we may use your personal information, where necessary, to investigate issues and settle disputes.

Your consent. Generally, we do not rely on your consent to process your personal information where there is any lawful ground available or where your data is completely anonymized and de-identified. In any other case where we require your consent to collect, process, or store your personal data, we will clearly disclose it to you at that time.

Conditions and methods of personal information processing

The user consents to process their personal data by using our website and/or filling any form on our website. The processing of the user's personal data means the collection, recording, systematization, accumulation, storage, clarification (updating, changing), extraction, use, transfer (distribution, provision, access), depersonalization, blocking, deletion, and destruction of the user's personal data.

Concerning the user's personal information, its confidentiality is maintained, except in cases where the user voluntarily provides information about themselves for general access to an unlimited number of persons.

FXSSI may collect, use and share aggregated data to create anonymized statistical data for research or provide it to third-party service providers. In this case, we may use this information indefinitely without further notice to you. This data may be derived from your personal data but is not considered personal data in law as it does not directly or indirectly reveal your identity. For example, we may aggregate your Usage Data to calculate the percentage of users accessing a specific website feature. However, if we combine or connect aggregated data with your personal data so that it can directly or indirectly identify you, we treat the combined data as personal data, which will be used in accordance with this Privacy Policy.

Do we share your personal information?

We do not give, rent, lend, sell or otherwise disclose your personally identifiable information to third parties, except as described in this Policy. We will not use your personal information for any other purpose unless we describe how such information will be used at the time you disclose it to us, or we provide you with advance notice to obtain your permission. This does not include website hosting partners and other parties who assist us in operating our website, conducting our business, or serving our users, as long as those parties agree to keep this information confidential.

FXSSI may aggregate data on an anonymous basis (non-personally identifiable visitor information) about its clients (such as the number of visitors or registered users) and disclose such data to third parties for marketing, advertising, or other uses.

We may also disclose your personal information to third parties to fulfill your instructions or pursuant to your expressed consent. But in this case, we do not screen, approve and take no responsibility for how that third party gathers, stores, or processes your information.

We may also release information:

  • in response to official requests from government authorities or parties to legal proceedings (court orders, subpoenas, national security requests, etc.),
  • when its release is permitted or appropriate to comply with the law
  • to enforce our site policies and protect our or others' rights, property, or safety,
  • to protect us against legal liability.

For example, we may disclose personal information when we believe in good faith that the law requires us to comply with legal obligations or official requests, to prevent or investigate possible wrongdoing in connection with the service. In all cases, we may raise or waive any legal objection or right available to us at our sole discretion.

Third-party service providers. We may share some of your data only with authorized data processing organizations that provide services on our behalf in a manner that is aggregated with other user information and does not reveal any of your personally identifiable information.

We will share your personal data with third parties only if necessary for the provision of services and data you have requested. For example, we share information with organizations that help us operate the website or run promotions, facilitate your transactions with FXSSI, and with advertising organizations and networks that help us market and advertise our products and services, as well as to measure the effectiveness of those ads. Please note that we do not share personally identifiable information about our users with our advertising partners, but only general aggregated statistics.

Be advised that we may use third-party cloud service providers that provide hosting, data storage, and other services pursuant to standard terms and conditions that may be non-negotiable. These service providers have informed us or the general public that they apply security measures they consider adequate for the protection of information within their systems, or they have a general reputation for applying such measures. If you have reason to believe that your interaction with us is no longer secure, you are required to notify us through the "Contact Us" section.

Third-party service providers that assist FXSSI:

The third-party service providers that assist FXSSI in providing services to you are required to maintain the confidentiality of such information to the extent they receive it and to use your personal information only in the course of providing such services.

reCAPTCHA. Google reCAPTCHA is a service that protects our website from fraud, spam and abuse by ensuring whether the information has been entered by a person or by an automated program. This service analyses visitor's behavior based on some characteristics (e.g., IP address, visit duration, user's mouse clicks, etc.). The analysis starts automatically when a user enters our website and is performed in the background without informing the user. The collected data is forwarded to Google. Links to other sites. Our Service may contain links to other sites that are not operated by us. This Privacy Policy does not apply to those sites. As we have no control over and assume no responsibility or liability for the content, privacy policies, or practices of any third-party sites or services, we strongly advise you to review the Privacy Policy of every site you visit. You visit any third-party websites or applications at your own risk.

Business sales or bankruptcy. In the event of a corporate restructuring, merger, acquisition by another company, sale, or other business transition and transfer of assets or any portion of our business, your personally identifiable information may be among the assets transferred as permitted by law and/or contract. We reserve the right to transfer any and all information we collect from clients or that we otherwise collect in connection with the site to a third party. We'll notify you well before any info about you is transferred and becomes subject to a different privacy policy.

How does FXSSI protect your personal data?

We store users' personal data exclusively on electronic media and process it using automated systems. The exchange of personal data during the processing in information systems is carried out through communication channels protected by technical means of information protection. We encrypt your information using SSL and require multi-factor authentication to gain access to company systems or service provider systems used to operate our site.

When processing personal data in information systems, the company makes sure to:

  • take measures aimed at preventing unauthorized access to personal data and (or) their transfer to persons who do not have the right to access such information;
  • timely detect unauthorized access to personal data;
  • avoid the impact on technical means of automated processing of personal data, as a result of which their functioning may be disrupted;
  • take measures to provide the possible recovery of personal data modified and destroyed due to unauthorized access;
  • provide constant monitoring of the level of protection of personal data.

The security of your data is important to us. Though we take reasonable steps (physical, technical, and organizational security measures) to protect your personal information and ensure it is not accessed by unauthorized persons, and prevent other data breaches, we cannot guarantee its absolute security. Remember that no method of transmission over the Internet or electronic storage guarantees absolute security against all threats. Therefore, we do not accept liability for unauthorized or accidental disclosure to the fullest extent permitted by applicable laws. In case of any security breach, we may notify you by posting a corresponding notice on our website or by sending an email to you.

Users are also responsible for keeping their data safe. We advise you to use a unique, hard-to-guess password and not share it with others. If you believe that someone has gained access to your account without your permission, please, contact us immediately so that we can investigate.

Transfer of data. Your information, including personal data, may be transferred to and maintained on servers located outside of your state, region, province, country, or other governmental jurisdiction where the data protection laws may differ from those of your jurisdiction.

FXSSI will take reasonable steps necessary to ensure that your data is treated securely and in accordance with this Privacy Policy. In these circumstances, we will, as required by applicable law, ensure that your privacy rights are adequately protected by appropriate technical, organization, contractual or other lawful means.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

Protection of payment information. We implement a variety of security measures when a user places an order for our products and services to maintain the safety of their payment information.

We do not store, process, or have access to your payment information on our servers but use certified third-party service providers for payment processing on behalf of FXSSI (see the list of third-party service providers above). We may store and process information associated with your payment information (e.g., your billing details).

We use such information only for billing purposes. All payment details are provided directly to our third-party payment processors, whose use of your personal information is governed by their Privacy Policy. We, for our part, undertake to maintain the secrecy and security of the personal data transferred, according to the applicable law in this matter.

In case of any issues with processing your order, we will contact you using the email address you have provided.

How long does FXSSI store your personal data?

We will retain your personal data until you decide to delete your account and only for as long as necessary for the purposes it was retained, such as to enable you to use the website and products or provide services to you, resolve disputes, pursue legitimate business purposes, enforce our agreements, and/or comply with applicable laws (i.e., for tax, legal, accounting, fraud, or abuse prevention, and/or other purposes). Some data can be stored even after an account is deleted.

The storage of personal data is carried out in a form that allows determining the subject of personal data no longer than required for processing personal data, including for the purposes of satisfying any legal, accounting, or reporting requirements. The processed personal data is subject to destruction or depersonalization upon achievement of the purposes of processing or in case of loss of the need to achieve these purposes.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data, and whether we can achieve those purposes through other means and the applicable legal requirements.

We must also take into account the periods for which we may need to retain your personal data to comply with our legal obligations to you or regulatory authorities. In some cases, we may store data for a longer period in order to comply with applicable laws, resolve disputes with any parties, and otherwise, as necessary to allow us to conduct our business. All personal data we retain will be subject to this Privacy Policy.

Personal data whose processing period has expired will be destroyed or anonymized. In case we make your data anonymous so that it can no longer be associated with you, it will no longer be considered personal, and we may use it without further informing you.

How are your rights protected under the General Data Protection Regulation (GDPR)?

This section applies only to persons residing in the European Economic Area and the United Kingdom.

We are attentive to ensuring your rights under the GDPR. FXSSI aims to take reasonable steps to allow you to correct, amend, delete or limit the use of your personal data.

If you wish to exercise any of the rights described below, please, use the respective website functionality or contact us.

In some cases, we may need to request specific information or identity documents from you to help us confirm your identity and ensure your right to access your personal data (or exercise any of your other rights). It is a security measure to ensure that personal data is not disclosed to any person who impersonates you and has no right to receive it.

Please note that in some cases, we may not be able to comply with some of your requests to the extent that they would cause us to violate any law or infringe any other person's rights.

We will process any requests below free of charge unless they impose an unreasonable cost on us.

The right to access the information. By your request, we will confirm whether we are processing your personal data (that you consented to give us or that was provided to us as necessary in connection with our obligations to you) and if so, we undertake to provide you with information about the data we process. You have the right to obtain this data in a structured, commonly used, and machine-readable format. If you require any additional copies of such document, we may charge a reasonable fee, depending on the situation.

Articles 13 and 14 of the GDPR determine the list of data that we have to provide you upon your request. You can request this information at any time by contacting us and clarifying your specific requirements so that we can legally consider your request and provide an answer.

We will make a reasonable effort to process your requests as soon as possible. But please note that providing a complete legal response regarding your personal data can take up to a month, as it is a complex process.

The right to correct your personal data. If you notice that some of your personal data we process is incorrect or out of date, you can correct it yourself by logging into your personal account on the website. You can access, update or request deletion of your Personal Data directly within your account settings section. If you are unable to perform these actions yourself, please, contact us to assist you.

The right to delete your personal data. You can stop using our services and delete your personal data at any time. Please see the "How can you delete your personal information?" section below for more details.

The right to object and restrict personal data processing. You can object to our processing of your personal information at any time, and we will restrict or block such processing unless we have compelling legitimate grounds or requirements for such processing. We will notify you before we lift any restriction on processing.

Withdrawal of consent to the personal data processing. If we process your personal data (in particular to carry out statistical analytics, marketing, or promotions) based on your consent, further processing can be terminated at any time. You can withdraw your consent to such processing by contacting us.

The "right to be forgotten". You can exercise your right to be forgotten. In this case, based on Article 17 of the GDPR, we undertake to delete your personal data that we process, except for personal data that we will be obliged to keep under the requirements of the law.

The right to opt out of cookies. You have the right to opt out of non-essential cookies. For more information, please, visit our Cookie Policy.

The right to opt out of marketing emails. We may use your personal data to send you newsletters, marketing or promotional materials, and other information that may be of interest to you. You may opt out of these communications by clicking on the "unsubscribe" link included at the bottom of any marketing email you receive from us.

Please note that you will continue to receive non-promotional service- and transaction-related communication (e.g., emails about products and services updates, responses to your customer support requests, notifications about important updates to our policies, etc.). You cannot opt out of such communication unless you delete your account.

Advertising and your choices. We partner with a third-party ad network (Google's advertising) to either display advertising on our website or manage our advertising on other sites. Our ad partner may use cookies and other technologies to collect information about your activities on our and other websites to provide you with targeted advertising based on your interests.

Privacy notice for California users

We adopt this privacy notice to comply with the California Consumer Privacy Act of 2018 ("CCPA") and the California Online Privacy Protection Act ("CalOPPA"). This notice applies solely to California residents who visit or use our website, interact with us online, or receive our products or services. Below are the rights California users have with respect to the collected personal information and how they can exercise those rights.

California users may have the following specific rights:

Access to specific information and Data portability rights. Upon your request, we may disclose certain information to you about what personal data we collect, use, and disclose:

  • The categories of personal data collected about you in the last 12 months, the purposes of such collection, and whether we have disclosed it for a business purpose;
  • The categories of sources from which we collect personal information;
  • Our business or commercial purpose for collecting that personal information;

To exercise your access and data portability right, submit a request through the Contact Us form. You may only make access or data portability requests twice within 12 months.

Data deletion request rights. You have the right to request deletion of some or all your personal information we have collected, and we will do so unless there are certain applicable exceptions, such as:

  • we need your information to complete transactions, provide services that you request under our obligations, or otherwise perform our obligations to you;
  • your information is used to detect and prevent security issues, protect against spam and malicious, deceptive, fraudulent, or illegal activity;

Please note that the deletion of all your personal information will typically require the deletion of your account. To exercise the deletion rights, you can use the respective functionality of your personal account or submit a request through the Contact Us form.

Correction of information collected from you online. You have the right to correct the information that we collected about you online. If you entered information online and later need to correct that information, you can perform it:

  • By emailing us;
  • By logging in to your account;
  • By sending us a support ticket.

Right to opt out of the sale of your personal information. You have the right to opt out of the sale of your personal information and request information about whether we have sold your personal information in the past 12 months. Though FXSSI did not and does not sell your personal information, when you use our services, we may share your personal information with advertising partners in a way that may constitute a sale under the CCPA. You may opt out via the link provided on the relevant page or app. If we do not provide an opt-out mechanism, it is because we do not believe in good faith that your personal information is being sold.

California's "Shine the Light" law. California residents have the right to opt out of disclosing their personal information to third parties for the purpose of allowing such third parties to directly market their products and services.

Non-discrimination rights. You have the right not to receive discriminatory treatment by us because you have exercised your privacy rights. It means that you have the right not to be denied our services, charged different prices, or provided a different level or quality of services.

There may be situations when we will be physically or technically unable to provide you with the full scope of our services due to exercising your privacy rights. It should not be taken as discrimination.

"Do Not Track" signals. Most browsers have the functionality to request third-party websites, not to track the user's activities. FXSSI does not respond to "Do Not Track" signals when the (DNT) browser mechanism is in place. The third-party service providers we use for our website to function properly (e.g., social network features, Google Analytics, etc.) may set cookies on your browser, track and collect information about your online activities, notwithstanding any "Do Not Track" signals we may receive.

COPPA (Children Online Privacy Protection Act). We do not specifically market to children under the age of 13 years old. Therefore we do not knowingly collect personal information from anyone under the age of 13.

Fair Information Practices. In order to be in line with Fair Information Practices, we will notify you via email within 1 (one) business day should a data breach occur.

According to CalOPPA, we agree to the following:

  • Users can visit our website anonymously;
  • Once this privacy policy is created, we will add a link to it on our home page or, as a minimum, on the first significant page after entering our website;
  • Our Privacy Policy link includes the word "Privacy" and can easily be found on the page specified above.

Exercising your rights. Only you are authorized to submit any of these requests. We may need to verify your identity first to confirm that the personal information relates to you. We may not be able to fulfill your request until we can do so. In general, we may verify identity by confirming that you are the owner of the email address associated with the account or by asking you one or more knowledge-based questions about you and your account.

The verifiable consumer request must:

  • include sufficient information that allows us to verify you as a person about whom we collected personal information;
  • describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Although you are not required to have an FXSSI account to submit a request, we may not be able to locate certain information to process your request if you don't have one.

Any requested disclosures will only cover the 12-month period preceding the user request.

Response timing and format. Providing a complete legal response regarding your personal data can take up to a month, as it is a complex process. We will send you a notification through the email address you have provided us in case:

  • we need more time to process your request – the notification will include the reason and extension period;
  • we cannot process your request – the notification will include reasons, if applicable;
  • we require an additional fee to process your request – the notification will include the reason and estimated amount.

When exercising the data portability right, we will select the format that presents your information in a readily usable form and should allow you to transmit the information from one entity to another.

We process such user requests free of charge unless your requests are excessive, repetitive, or manifestly unfounded.

Security of your personal information. To protect your personal information from unauthorized access, we use security measures that comply with applicable law, including Secure Socket Layers (SSL).

You will be notified of any Privacy Policy changes:

  • On our Privacy Policy Page;
  • Through email notification when required by law or by the new Privacy Policy edition.

Privacy notice for Nevada users

If you are a resident of Nevada, you have the right to opt out of the sale of certain "covered information" to third parties who intend to license or sell that personal information. Currently, we do not sell and have no plans to sell this personal information of our users to any third party. We may share your data as explained in this Privacy Policy, such as to enhance your experiences and our services, and those activities will be unaffected by a Nevada do not sell request.

However, if we decide in the future to sell personal information covered by the Act and you would like to be notified, you can provide us with your name and email address associated with your account.
